SALESmanago Marketing Automation Anti-spam policy

Creating an account in the System and accepting the Terms of use is considered to consent to the rules of Anti-spam policy.

Definition of Spam

The term „Spam” refers to unwanted e-mail containing commercial information sent to the specified recipient, which was not solicited by him or did not agree to receive it. It is known as:

  • UCE – unsolicited commercial e-mail
  • UBE – unsolicited bulk e-mail

Policies

  1. Every User of the System agrees that it is strictly forbidden to send spam using SALESmanago Marketing Automation.
  2. Every User of the System agrees to send e-mails only to verified contacts that have given permission to receive messages and in particular disclosed their e-mail address.
  3. Each message sent from the system must contain:
    • Name and address in message header ‚from’
    • Real ‚reply-to’ address
    • Footer that contains the data of the sender
  4. The content of e-mail must be consistent with the law and accepted principles of morality.
  5. Each message sent from the System must contain correctly described, highly visible and active link that allows addressee resign from receiving e-mail.
  6. If the addressee resigned from receiving e-mail it is not allowed to change that status without addressee approval.
  7. Each User of the System undertakes to comply with the provisions of generally applicable law, in particular: general data protection regulation – GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016), Polish Act of 10 May 2018 on the protection of personal data, Polish Act of 18 July 2002 on provision of services by electronic means, Polish Act of 16 July 2004 – Telecommunications Law and the Act of 28 July 2023 on combating abuse of electronic communications.
  8. It is strictly prohibited for any User of the System to send marketing messages via the System with the intention of causing harm to third parties (e.g. phishing marketing messages).

Sanctions

  1. Owner of the System reserves the right to terminate the agreement for use of the System in case of the User’s non-compliance with the principles set out in the Anti-spam policy and after finding that the User did not response for given warning.
  2. Owner of the System reserves the right to immediate account lockout and block ongoing shipments of e-mails if it finds that the User sent an e-mail to spamtrap, which are addresses or domains detecting cases of sending messages without the required approvals.
  3. Owner of the System reserves the right to block User’s account if it finds that in result of the shipment of e-mails one of the IP SALESmanago Marketing Automation addresses is added to the blacklist (RBL) conducted by an external entity in order to block spam senders.
  4. In the event of a complaint of an end user about receiving an unsolicited e-mail or an e-mail with unwanted content, Owner of the System reserves the right to block User’s account or/and block ongoing shipments of e-mails.
  5. In the case of the blocking or multiple blocking of User’s account due to breach of the Anti-spam policy the Owner of the System reserves the right to block User account or/and block ongoing shipments of e-mails without giving a reason.

Data validation

  1. The batch data uploaded into the System is validated for technical correctness only, in an automated manner.
  2. In the case of the output data, we check the content of the marketing message for the correctness of the communication, in particular with regard to: redirects to unsafe websites, content that may lead to phishing, impersonation of another sender, accumulation of spamming words. Verification in this respect takes place automatically, using tools as well as human intervention. Failure of positive verification may lead to the blocking of the System User’s messages, of which the User will be informed, together with an indication of the reason for such blocking.

Internal complaint handling system

  1. A User of the System who does not agree with the blocking of a particular marketing communication and/or User account on the System may make a complaint about the action taken by us by sending the relevant notification to: notify@salesmanago.com.
  2. We will respond to the complaint within 30 days of receipt, with the proviso that this deadline may be extended in particularly complex cases. Exceeding the deadline for responding to a complaint does not constitute recognition of the complaint.
  3. If there are deficiencies in your complaint which make it impossible to respond to it, we will ask you to complete them. In such a case, the time limit indicated under point 2 will be extended accordingly.
